SOUTH PORTLAND — The city announced Wednesday that it will seek to retain the Boston-based law firm Foley Hoag to defend against a lawsuit filed earlier this month by the Portland Pipe Line Corp. and American Waterways Operators.

Maine Municipal Association provides insurance coverage for the city’s liability and public officials, but there is no coverage available for the city in the nine-count lawsuit that challenges the legality of the city’s Clear Skies Ordinance, according to a press release. 

“The law firm has extensive experience litigating federal preemption, commerce clause and maritime law cases,” the release said. 

Foley Hoag would be assisted by Portland-based Jensen Baird Gardner & Henry. The City Council will vote on the recommendation at its meeting Monday, March 2.
