SCARBOROUGH — A local man will spend six months in jail for stealing $50,000 from an American Legion post in York.

Ryan J. Byther, 36, was sentenced Tuesday by Justice John O’Neill in York County Superior Court to five years in jail, with all but six months suspended. A jury in February found Byther guilty of Class B theft by deception.

Court records show Byther was a contractor working at American Legion Post 56 in 2008 when he told post members he was a professional fundraiser capable of managing a $2 million campaign.

At his trial, evidence was presented showing Byther lacked the fundraising experience and licensing he claimed, and that he used a $50,000 retainer from the post to fund other struggling business ventures.

Byther was also sentenced to three years of probation and to pay $50,000 in restitution.
