SOUTH PORTLAND — A perjury charge against city business owner Vincent Maietta, 55, was dropped for lack of evidence by the Cumberland County district attorney’s office on Oct. 9.

On Oct. 31, Maietta’s brother, Robert, 49, will be in Cumberland County Superior Court seeking dismissal of a perjury charge he faces.

The brothers were indicted on the Class C counts by a Cumberland County grand jury June 7. The charges stemmed from an April 1 city public hearing about towing fees assessed at companies owned by the brothers, and a subsequent complaint filed against South Portland Police Sgt. Todd Barlow.

The hearings resulted in City Clerk Sue Mooney suspending Maietta Towing from city-commissioned work for five months for violations of the city code governing towing fees.

Barlow’s investigation of the company revealed at least four instances of overcharging in about six weeks late last winter. After the April 1 hearing, Robert Maietta filed a protection from harassment order against Barlow in Portland District Court, citing a profanity-laden tirade Barlow allegedly made.

The protection order led to an internal police investigation, South Portland Police Sgt. Steve Webster said at the time. The police then forwarded statements made by the Maiettas to District Attorney Stephanie Anderson.

Tamara Getchell, spokeswoman for the DA, did not respond to calls about the case against the Maietta brothers.
