FALMOUTH — The Town Council on Monday night unanimously agreed to create a special overlay district for a Gray Road business owner.

Councilors amended the zoning and site plan review ordinance to make the overlay district for Joe Cooper, owner of 60 Gray Road, so he can have parking in the front setback.

While councilors had some reservations about “spot zoning,” they decided the property is unique because part of the land is owned by the Maine Department of Transportation, which widened a right of way and reduced the setback.

Councilor Charlie McBrady, who introduced the item, said Cooper’s goal is to re-purpose the industrial lot for a retail building.
